These Terms of Service ("Terms") govern your use of the EverRegistry website at everregistry.com.au, the EverRegistry Quick Add browser extension, and related services (together, the "Service"), operated by Kurtis Simpson (ABN 84 901 335 408), trading as EverRegistry ("we", "us", "our"), from Australia.
By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. The Service
EverRegistry is a universal baby registry. You can build a registry of items from any store, share it with friends and family via a link, and receive personalised product recommendations that adapt as your baby grows. Gift-givers can reserve and mark items as purchased to avoid doubled-up gifts.
We are a registry and recommendation service only. We do not sell products. All purchases are made directly with the relevant retailer, on that retailer's terms.
2. Eligibility and accounts
- You must be at least 18 years old to use the Service.
- You can start a registry without an account. Draft registries are tied to a private token in your browser; if you clear your browser data or lose the device before claiming the draft with an account, the draft may be unrecoverable.
- You are responsible for keeping your sign-in methods (email, passkeys, linked Google account) secure, and for all activity under your account.
- You must provide accurate information and keep it up to date.
3. Registries, share links, and guests
- Registries are shared via a link. Anyone with the link can view the registry and its contents. You are responsible for choosing who you share the link with.
- You can invite others by email to view a registry or help manage it. People you give management access to can change the registry; invite only people you trust.
- Guests may reserve items and mark them as purchased. Reservations are a coordination tool, not a binding commitment, and we are not responsible if a reserved item is not ultimately purchased, is purchased by someone else, or becomes unavailable at the retailer.
4. Your content
You retain ownership of the content you add to the Service (registry details, item notes, images, and similar). You grant us a non-exclusive, worldwide, royalty-free licence to host, store, display, and transmit that content as needed to operate the Service — including displaying it to the people you share your registry with.
You are responsible for the content you add and must have the right to add it.
5. Acceptable use
You must not:
- Use the Service for any unlawful purpose.
- Add content that is offensive, misleading, infringing, or harmful.
- Access or attempt to access another person's registry, account, or data without authorisation.
- Interfere with the Service, including scraping at scale, circumventing rate limits, or probing for vulnerabilities.
- Resell or commercially exploit the Service without our consent.
We may moderate, edit, or remove content, and suspend or terminate access, where we reasonably believe these Terms have been breached.
6. Third-party retailers and product information
- Product details shown on the Service (including titles, images, prices, and availability) are drawn from retailer websites and our catalogue, and may be out of date or inaccurate. Always check the retailer's page before purchasing.
- Links to retailers are provided for convenience. We are not responsible for retailers' products, pricing, delivery, returns, or conduct. Your purchase contract is with the retailer, and the retailer is responsible to you under the Australian Consumer Law for the products it sells.
7. Recommendations are general information only
Our recommendations are generated from your questionnaire answers, your baby's age and sizes, seasonal information, and your feedback. They are general suggestions, not professional, medical, or safety advice. You are responsible for assessing whether any product is safe and suitable for your child, including checking current Australian safety standards and product recalls, and following manufacturer instructions and age guidance.
8. Smart Features and payment
- The core registry features are free. Smart Features (including personalised recommendations and growth stages) are available for a one-time payment, processed by Stripe, in the amount shown at checkout.
- The payment is a one-time unlock for the Smart Features as described at the time of purchase, including future improvements to them. It is not a subscription and there are no recurring charges.
- Nothing in these Terms excludes your rights under the Australian Consumer Law, including consumer guarantees. If Smart Features fail to meet a consumer guarantee, you are entitled to the remedies the law provides. Beyond your statutory rights, if something has gone wrong with your purchase, contact us at support@everregistry.com.au and we will try to put it right.
9. Browser extension
The EverRegistry Quick Add extension lets you add products to your registry from retailer pages. It only reads the page you are on when you activate it, and it communicates only with EverRegistry's servers. Your use of the extension is subject to these Terms and our Privacy Policy, as well as the policies of the browser store you install it from.
10. Intellectual property
The Service — including its software, design, branding, and catalogue — is owned by us or our licensors. Except for your own content, you may not copy, modify, or distribute any part of the Service without our permission. Retailer names, product names, and trademarks belong to their respective owners; their appearance on the Service does not imply any affiliation or endorsement.
11. Availability and changes to the Service
We aim to keep the Service available and reliable, but it is provided on an "as available" basis and may be interrupted for maintenance, updates, or events outside our control. We may add, change, or withdraw features over time. If we ever discontinue the Service or a paid feature in a way that materially affects you, we will give you reasonable notice where practicable.
12. Termination
You can stop using the Service and request deletion of your account at any time. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive (including sections 4, 6, 7, 13, and 14) survive termination.
13. Liability
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded.
To the extent permitted by law: where we are liable for a breach of a non-excludable consumer guarantee in relation to services, our liability is limited (at our option) to resupplying the services or paying the cost of having them resupplied; and we are not liable for indirect or consequential loss, or for loss arising from retailer products or conduct, content added by other users, gift coordination outcomes, or events outside our reasonable control.
14. General
- These Terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of its courts.
- If any part of these Terms is found invalid, the rest remains in effect.
- We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by email, and the changes will apply from the date we indicate. Continuing to use the Service after that date means you accept the updated Terms.
- You may not assign these Terms without our consent. We may assign them as part of a business restructure or sale, provided your rights are not reduced.
